Conversational AI platforms such as ChatGPT, which presently face restrictions in China, played a considerable role in the AI surge in 2023. This AI mechanism, trained using extensive datasets, has received international acclaim for its dialogue abilities. Taking a leaf from its success story, major Chinese technology firms like Baidu, Alibaba, and JD.com are developing their chatbot variants.

The Chinese government, nevertheless, remains alert. There are apprehensions that generative AI may create content that conflicts with Beijing’s ideologies. Consequently, the Chinese authorities, known for their stringent control over internet services, are devising laws and regulations for the industry.

A Balanced AI Strategy: Growth and Regulation

In collaboration with seven state agencies, the Chinese Cyberspace Administration (CAC) is developing a regulatory framework to guide the country’s tech giants. Along with entities like the National Development and Reform Commission and the education, science, and technology ministries, the CAC will oversee the 24 regulations introduced.

These rules, available to the public, don’t apply to AI developed in research institutions. AI service providers, however, are mandated to obtain approval from the CAC.

Easing the Pathway to Innovation

The final guidelines are a more relaxed draft, signaling a cautious yet tolerant approach. Angela Zhang, Director at the University of Hong Kong’s Center for Chinese Law, believes this indicates China’s willingness to attract more investments in AI, aspiring to outrank the US.

However, challenges persist. The involvement of seven agencies complicates understanding the exact execution style, says Frances Du, founding partner of J Ventures.

The final guidelines also offer flexibility. For instance, they remove the strict three-month grace period for removing undesired content and a fine of up to $14,000 for breaking the law. You Chuanman, Director of the IIA Center for Regulation and Global Governance at the Chinese University of Hong Kong’s Shenzhen campus, welcomes these changes. He emphasizes the new rules’ more significant focus on promoting development, considering them more feasible and flexible.
